Affidavit of Support Exemption: Who Qualifies and How It Works

Many people believe that every green card applicant must have a financial sponsor who submits an Affidavit of Support (Form I-864). However, some applicants are exempt from this requirement if they have earned 40 qualifying quarters (credits) with the Social Security Administration (SSA).
What Are Social Security Credits?
Social Security credits are units of work that the Social Security Administration gives for covered earnings each year — up to four credits per year.
In simple terms:
40 credits = about 10 years of credited work in the U.S.
If an applicant has earned 40 credits through authorized employment, USCIS may exempt them from filing Form I-864, the Affidavit of Support.
Who Can Qualify for the Affidavit of Support Exemption?

Anyone who has worked legally in the United States with valid authorization can accumulate credits. This includes individuals who held:
DACA
TPS
Any other valid work permit (EAD)
You can check your record and download your work history by creating an account at https://www.ssa.gov/myaccount/
Documents Needed to Prove the Exemption
You’ll need to show that the 40 credits were earned with valid work authorization by submitting:
Copies of your Employment Authorization Documents (EADs)
Your Social Security earnings statement showing 40 credits
Even With an Exemption, USCIS Reviews Public Charge Factors
Even when someone is exempt from the I-864, USCIS still conducts a public charge analysis. Officers may consider factors such as: your current income and assets, debts, work history and employment stability, health conditions, and if the applicant received cash assistance at government expense in the past, etc.
