When completing the Affidavit of Support (Form I-864), USCIS asks for three years of tax returns. The most recent year is required and the second and third years are generally optional. What USCIS officers really focus on is whether your current income meets the minimum requirement for your household size, which may differ from what your previous year’s taxes show.
If your income was below the required level last year but has since increased—due to a new job, raise, or additional employment—and now you meet the requirement, you can qualify by proving your current earnings.
Acceptable evidence includes:
Last three months of pay stubs.
An employment verification letter stating your position, salary, and start date.
Providing accurate, up-to-date financial proof is essential to avoid delays or a Request for Evidence (RFE), which can add months to your case.
